Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you in its entirety. In such cases, Punch Pizza's liability shall be limited to the greatest extent permitted by applicable law.

EXCEPT FOR CLAIMS THAT QUALIFY FOR SMALL CLAIMS COURT, YOU AND PUNCH PIZZA AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF OUR WEBSITE OR SERVICES SHALL BE RESOLVED EXCLUSIVELY THROUGH BINDING INDIVIDUAL ARBITRATION, AND NOT IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

The arbitration shall be conducted by a recognized arbitration organization, such as the American Arbitration Association (AAA) or JAMS, in accordance with their applicable rules, which are available on their respective websites. The arbitration shall take place in the United States in a location mutually agreed upon by the parties, or via videoconference if the parties so agree.

The arbitrator shall have the authority to award any remedy that would otherwise be available in a court of law, subject to the limitations set forth in these Terms. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

14.3 Class Action Waiver

YOU AND PUNCH PIZZA EACH AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION. YOU EXPRESSLY WAIVE ANY RIGHT TO FILE OR PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. IF THIS WAIVER IS FOUND TO BE UNENFORCEABLE, THE ARBITRATION AGREEMENT SHALL BE NULL AND VOID WITH RESPECT TO THAT CLAIM.

14.4 Small Claims Exception

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes or claims that fall within the jurisdictional limits of such court, so long as the action remains in small claims court and is not removed or appealed to a court of general jurisdiction.
